Decree No. 40/2019 / ND-CP amending and supplementing a number of articles of the decrees detailing and guiding the implementation of the Law on Environmental Protection promulgated on May 13, 2019 by the Government has scope Very wide adjustment. With the scope of adjustment of 04 Decrees related to environmental protection, including: Decree No. 18/2015 / ND-CP dated February 14, 2015 on environmental protection planning and environmental assessment strategic school, environmental impact assessment and environmental protection plan; Decree No. 19/2015 / ND-CP dated February 14, 2015 detailing the implementation of a number of articles of the Law on Environmental Protection; Decree No. 38/2015 / ND-CP dated April 24, 2015 on Regulations on waste and scrap management; Decree No. 127/2014 / ND-CP dated December 31, 2014 defining the conditions for organizations conducting environmental monitoring services.
The majority of enterprises in IZs participated in the training. At, the
training session was conveyed by the reporters of the Department of
Environmental Protection - Department of Natural Resources and Environment
conveyed new points of the Decree with the following contents:
1. Amend and supplement a number of articles of the Government's Decree
No. 18/2015 / ND-CP of February 14, 2015 on environmental protection planning,
strategic environmental assessment and environmental impact assessment and
Environmental protection plan:
- A project is an environmental profile;
- Subjects subject to environmental impact assessment of Appendix II and
Appendix IIa have regulations on types of industrial production likely to cause
environmental pollution and subjects subject to trial operation of quality

2. Decree No. 19/2015 / ND-CP dated February 14, 2015 of the Government
detailing the implementation of a number of articles of the Law on
Environmental Protection:
Amendments and supplements to: certification of environmental management
system; Establishments causing serious environmental pollution (ONMTNT) are establishments
that commit acts of violating the discharge of wastewater, dust, exhaust gas,
causing noise pollution, vibration in excess of Vietnamese standards or burial,
dumping, dumping or discharging substances. discharge solid wastes or hazardous
wastes in contravention of regulations on environmental protection, to the
extent that they are subject to an additional sanction of operation suspension;
regulations related to environmental protection funds and incentives for
environmental protection;
3. Decree No. 38/2015 / ND-CP dated April 24, 2015 of the Government
stipulating the management of waste and scrap:
Amending and supplementing: Removing the retrospective regulations used
the declaration, commitment, plan, environmental protection scheme, ... to compile
a dossier of application for a license to treat and co-handle hazardous waste;
amend and supplement regulations on management of domestic waste and ordinary
industrial waste; Concretize a number of provisions of Resolution No. 09 /
NQ-CP on assigning the Ministry of Natural Resources and Environment to preside
over and uniformly perform state management of waste; Strengthen recycling and
reuse of ordinary industrial wastes as raw materials for production of
construction materials, ground leveling and use in construction works if they
comply with technical regulations, standards or instructions. art; Domestic
waste treatment facilities, ordinary industrial waste must apply the
environmental management system according to ISO 14001; amendment of regulations
on wastewater management; Works to prevent and respond to environmental
incidents must be specified in the EIA or be additionally approved if there is
no such work in the EIA report; amending and supplementing regulations on
observation and licensing of waste water and waste gas discharge; on specific
waste management, management of imported scrap as raw production materials.
4. Decree No. 127/2014 / ND-CP dated December 31, 2014 of the Government
stipulating conditions of organizations conducting environmental monitoring
services:
Amending and supplementing: conditions for granting Certificate: “Having
a Certificate of registration of testing activities suitable to the environment
field issued by the competent authority as prescribed in Decree No. 107/2016 /
ND-CP dated July 1, 2016 of the Government providing conditions for business of
conformity assessment services; "; Change the content related to operating
conditions of environmental monitoring services to suit the reality and field
of environmental management; Abolish some unnecessary business registration and
not under the management of natural resources and environment sector.
After each working session, the reporters received many comments from the
officers in charge of the environmental work of the IZs and asked for answers,
detailed instructions on each specific issue such as :
- For projects which require expert advice? How is called transfer?
- If, during the commissioning period, the work requires waste monitoring
(composite sampling), it is expensive and difficult for enterprises to
implement.
- When handing over daily-life wastes to fully functional units, must the
minutes of handing over the waste be signed and stamped immediately?
- The quantity required to repeat EIA? What is the main production line?
- Is the goal of leasing factories, offices and warehouses subject to
EIA?
